About Research Topic: Reduction in Sentence for a Guilty Plea: Judicial Perspectives.
The focus of my study is the practice of granting an accused person a discount in sentence in return for tendering a plea of guilty. The study examines the operation of section 196 of the Criminal Procedure (Scotland) Act 1995, the leading case of Du Plooy v H.M. Advocate and subsequent case law. The study documents the views of sentencers (Sheriffs and Senators of the College of Justice) on the operation of the sentence discount principle.
